Host Terms of Service

These Host Terms of Service apply to any person or business that submits, lists, or offers parking property through Tailgate.

By submitting a host application and affirmatively accepting these Host Terms, you agree to them.

Host Eligibility

A host must be at least 18 years old and legally capable of entering into an agreement.

A host must provide accurate contact and property information.

Pre-Launch Status

Tailgate is currently in a pre-launch host-onboarding phase.

Submitting a parking space allows Tailgate to evaluate, prepare, and potentially display the space on the marketplace.

Submission does not guarantee:

  • approval;
  • publication;
  • reservations;
  • occupancy;
  • pricing;
  • revenue; or
  • earnings.

Paid reservations and payouts are not currently open to the general public.

Before paid bookings launch, Tailgate may provide hosts with updated payment, payout, cancellation, fee, insurance, or other terms that must be accepted before participating in paid reservations.

A pre-launch submission does not obligate Tailgate to publish a listing or obligate the host to participate in paid bookings unless and until the applicable future terms are accepted.

Authority to Offer the Property

By submitting a parking space, the host represents and warrants that the host has sufficient legal authority to offer parking at the property.

The host must either:

  • own the property; or
  • have permission from the property owner or another person or entity legally authorized to permit the proposed parking activity.

The host is solely responsible for determining whether a lease, landlord rule, homeowners association rule, deed restriction, property agreement, mortgage provision, zoning requirement, permit requirement, business rule, or other legal or contractual obligation restricts the proposed parking activity.

Tailgate's review, approval, publication, or continued display of a listing does not constitute legal advice or confirmation that the host possesses every permission required to offer parking.

Listing Accuracy

Hosts must provide truthful and materially accurate information regarding their property and parking spaces.

This includes, when applicable:

  • location;
  • number of spaces;
  • availability;
  • photographs;
  • property type;
  • vehicle restrictions;
  • access limitations;
  • surface conditions;
  • hazards;
  • parking instructions;
  • amenities;
  • pricing information; and
  • any other condition a reasonable customer would consider important.

Hosts must promptly inform Tailgate if material listing information becomes inaccurate.

Tailgate Review Is Not a Guarantee

Tailgate may review host submissions before publication.

Such review does not constitute a professional property inspection, title search, background check, insurance verification, legal-compliance determination, safety certification, or guarantee concerning the host or property unless Tailgate expressly describes a particular verification process.

Hosts remain responsible for the truthfulness, legality, safety, and operation of their parking offerings.

Photos and Content

A host represents that the host owns or otherwise has the right to submit photographs, descriptions, and other listing content.

By submitting content, the host grants Tailgate a non-exclusive, worldwide, royalty-free license to host, reproduce, crop, resize, format, display, distribute, and use the content as reasonably necessary to operate, advertise, and promote Tailgate and the host's listing.

Hosts should avoid submitting photos containing unnecessary personal information, visible private documents, or other content they do not have permission to publish.

Availability and Reservations

Once paid bookings launch, hosts will be responsible for keeping availability accurate and honoring confirmed reservations.

A host must not knowingly offer a parking space that is unavailable or that the host lacks authority to provide.

Repeated cancellations, unavailable spaces, or materially inaccurate listings may result in suspension or removal.

Parking Access

Hosts are responsible for providing a customer reasonable access to the reserved parking space during the applicable reservation period.

Hosts should provide clear instructions concerning where the customer may park and disclose material restrictions.

Hosts may not direct customers to park on property the host does not have authority to provide.

No Vehicle Custody or Valet Service

Unless Tailgate expressly authorizes a separate service in writing, Tailgate listings are for self-parking only.

Hosts must not require customers to surrender vehicle keys, move customer vehicles, provide valet services, or otherwise take custody of vehicles through Tailgate.

A standard Tailgate reservation does not create a bailment or vehicle-safekeeping relationship between Tailgate and the customer.

Property Condition and Safety

Hosts are responsible for maintaining reasonable conditions on property offered through Tailgate and for disclosing material hazards or unusual access conditions.

Hosts should take reasonable steps to avoid directing customers into conditions the host knows are unsafe or unlawful.

Tailgate does not control the day-to-day condition of independently owned host property.

Insurance

Tailgate does not provide homeowners, renters, automobile, commercial-property, general-liability, or other insurance coverage for hosts unless Tailgate expressly states otherwise in writing.

Hosts are responsible for determining whether their existing insurance permits or covers parking activity conducted through Tailgate and whether additional insurance is appropriate.

A host should consult the host's insurer or insurance professional when uncertain about coverage.

Compliance With Laws and Property Rules

Hosts are responsible for complying with applicable laws, ordinances, regulations, permits, zoning requirements, tax obligations, contractual property restrictions, and other rules applicable to their parking activity.

Tailgate's publication of a listing does not waive or override those requirements.

Customer Conduct

Hosts should report material safety concerns, property damage, suspected fraud, threats, or significant disputes involving a Tailgate user.

Hosts should not discriminate or engage in unlawful, threatening, deceptive, or harassing conduct.

Pricing, Fees, and Payouts

Paid reservations and host payouts are not currently available to the general public.

Before paid bookings launch, Tailgate will disclose the applicable pricing, platform fees, payment-processing structure, payout procedures, cancellation treatment, and related terms.

Hosts will have an opportunity to review applicable terms before participating in paid reservations.

Tailgate does not guarantee any minimum number of reservations, occupancy level, revenue, or earnings.

Taxes

Hosts are responsible for determining and satisfying taxes applicable to money they receive through their parking activities except to the extent Tailgate or a payment provider is expressly required by law to collect, report, withhold, or remit a particular amount.

Independent Host Relationship

Hosts are independent marketplace participants.

Nothing in these Host Terms creates an employment, partnership, franchise, joint venture, fiduciary, or agency relationship between a host and Tailgate.

Hosts have no authority to make promises, representations, contracts, or commitments on behalf of Tailgate.

Claims and Incidents

Hosts should promptly notify Tailgate of material accidents, injuries, disputes, property damage, suspected fraud, or other significant incidents relating to a Tailgate reservation.

Tailgate may request reasonable supporting information when investigating an incident or enforcing marketplace policies.

Host Indemnification

To the maximum extent permitted by law, the host agrees to defend, indemnify, and hold harmless Tailgate and its owners, officers, employees, agents, affiliates, successors, and assigns from third-party claims, liabilities, damages, losses, penalties, costs, and reasonable attorneys' fees arising out of or relating to:

  • the host's property or parking operation;
  • bodily injury, death, or property damage occurring on or in connection with the host's property to the extent caused by the host, the property's condition, or persons for whom the host is responsible;
  • the host's listing or submitted content;
  • the host's lack of ownership, permission, or authority to offer the property;
  • violation of a lease, landlord rule, HOA rule, deed restriction, permit requirement, zoning rule, tax obligation, law, or other property restriction;
  • infringement of another person's intellectual-property or privacy rights through host-submitted content;
  • the host's material breach of these Host Terms; or
  • the host's negligent, fraudulent, unlawful, or intentional conduct.

This indemnification obligation does not require the host to indemnify Tailgate to the extent a claim results solely from Tailgate's gross negligence, willful misconduct, or another liability that applicable law does not permit Tailgate to transfer.

Disclaimer and Limitation of Liability

Tailgate provides marketplace technology and does not guarantee customer demand, host earnings, event attendance, uninterrupted website operation, or the conduct of customers.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAILGATE WILL NOT BE LIABLE TO A HOST FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS OPPORTUNITIES, OR EXPECTED RESERVATION REVENUE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAILGATE'S AGGREGATE LIABILITY TO A HOST ARISING FROM THE HOST'S USE OF THE MARKETPLACE WILL NOT EXCEED THE GREATER OF:

  1. THE FEES ACTUALLY RETAINED BY TAILGATE FROM TRANSACTIONS ATTRIBUTABLE TO THAT HOST DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. $100.

These limitations do not apply where applicable law prohibits limitation or exclusion.

Suspension and Removal

Tailgate may reject, modify, suspend, unpublish, or remove a host listing or restrict a host's access when reasonably necessary because of:

  • inaccurate information;
  • lack of authority to offer a property;
  • suspected fraud;
  • repeated cancellations;
  • customer complaints;
  • safety concerns;
  • unlawful conduct;
  • violation of these Host Terms; or
  • activity that threatens customers, third parties, Tailgate, or marketplace integrity.

University and Athletic Independence

Tailgate is an independent marketplace and is not affiliated with, sponsored by, endorsed by, or operated by The University of Alabama or Alabama Athletics.

Hosts may not describe a Tailgate listing as official University of Alabama or Alabama Athletics parking unless the host independently possesses specific authorization to make that representation.

Governing Law

These Host Terms are governed by the laws of the State of Alabama without regard to conflict-of-law principles.

To the extent legally permitted, disputes relating to these Host Terms will be brought in an appropriate state or federal court located in Alabama.

Severability

If any provision is found unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.

Changes to These Host Terms

Tailgate may update these Host Terms as the marketplace develops.

Hosts may be required to affirmatively accept revised terms before participating in future paid reservations.
